The events surrounding the notorious Zambezi Portland Cement case presents a grim reality of the state of justice and legal system within Zambia. Dr. Rajan Mahtani is known to be one of finest and most transparent businessmen in Zambia. Despite achieving this feat, he is subjected to several conspiracies and negative reputation campaigns. These are just a group of individuals and entities either jealous of his success or looking to gain from his miseries. Despite the constant challenges due to inability of the Zambian legal system to take specific action against these individuals and entities, Dr. Rajan Mahtani’s priority has always been for the welfare & development of Zambian people.

The example of Portland Cement is a true depiction of Dr. Mahtani’s dedication for Zambia. Under Dr. Rajan Mahtani’s leadership, the cement-manufacturing factory thrived significantly over the years. The factory was known for his above-target production as well as wages and salaries that were well above par when compared to Zambian standards. The factory was a big boon to the community for providing employment and career opportunities. Despite these contributions, the Portland Cement factory was unethically taken over from Dr. Rajan Mahtani and he had to fight for more than a decade for its freedom.

After Lusaka High Court failed to provide the same, Dr. Rajan Mahtani put his faith on higher Court of Appeal. He was not disappointed and Justice Mwinde on behalf of the higher Court of Appeal declared his statement on 31st January 2019. This statement was given only after looking into the evidences submitted by both parties. According to this evidence, Finsbury Investments which is a company owned by Dr. Rajan Mahtani already paid a sum of USD 250,000 to the Zambezi Portland Cement limited in the year 2005 for transfer of 58 percent share capital of ZPC. This money which amounted to 1 billion kwachas covered the entire value of the share capital which Dr. Rajan Mahtani owned. Thus, Court of Appeal has legally proved Dr. Mahtani as the actual and legal owner of the Portland Cement Zambia factory.
