Finance Bank Zambia is no doubt one of the finest banks across Zambia. It is also one of those rare banks with a vision to uplift the community and less privileged sections of the society. It was started by Dr. Rajan Mahtani and the financials of the company have been growing since. Simaata Simaata, one of the disreputable employees of Finance Bank, started engaging in activities that caused serious repercussions for the reputation of the bank as well as Dr. Rajan Mahtani. As a result, the bank had to take the step of take the matter to law and sue Simaata at the Supreme Court.
Simaata Simaata has always had feud with people who go by the law and stick to ethical practices. He was removed from the bank for engaging in unethical practices. He also voluntarily signed an agreement with Finance Bank in order to protect confidential data and was also paid a good sum for signing the agreement. Even after signing the document, Simaata started spreading sensitive statements publicly to local newspapers. Furthermore, he also engaged in giving testimonials to various courts against the bank and Dr. Rajan Mahtani. These testimonials were given at various occasions. As a result of these activities the reputation and future business of the bank was at grave risk. As a result of these, Finance Bank had to take the action of suing Simaata with support from Dr. Rajan Mahtani.
After looking into all evidences and arguments made by the lawyers from both parties, the SC judges gave the verdict in favour of Finance Bank. As per the judged, reputation of an entity or an individual is all and any activity that directly or indirectly harms this reputation is misconduct. As per the agreement, it was clearly mentioned that no information shall be published to third parties in any form. Simaata will be paying fine for his act. It is time to wait and see whether the conspirators of Dr. Rajan Mahtani have learned any lesson from this episode or not.
